General terms and conditions

§ 1 Scope and provider
(1) These general terms and conditions apply to all orders placed via the online shop at lescannasseurs.de.
(2) The provider and contracting party is Maximilian Luthe, trading as "Les Cannasseurs", Augustenburger Straße 53, 24537 Neumünster, Germany, phone: +49 176 89912441, email: info@lescannasseurs.de (hereinafter "we").
(3) Our offer is aimed exclusively at persons of legal age.
(4) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.
(2) You can order as a guest or with a customer account. You place the desired products in the shopping bag and then enter your delivery and payment details. Before you submit the order we show you all details once more; you can check and correct them there.
(3) By clicking the button "Zahlungspflichtig bestellen" ("Order and pay") you submit a binding offer to purchase the goods in the shopping bag.
(4) The contract is concluded when we confirm your order by email. We send this order confirmation immediately after receiving your order.
(5) We store the text of the contract. You receive the order details, these general terms and conditions and the withdrawal information by email with the order confirmation.
(6) The language of the contract is German.
§ 3 Prices and shipping costs
(1) All prices are final prices in euros and include statutory value added tax.
(2) For shipping within Germany we charge €6.90 per order. From an order value of €120 we deliver free of shipping costs. The relevant figure is the value of the goods after deduction of discounts.
(3) Shipping costs are shown separately in the shopping bag and before the order is completed.
§ 4 Delivery
(1) We deliver exclusively to delivery addresses in Germany.
(2) The delivery time is approx. 7 to 14 working days from conclusion of the contract, unless stated otherwise for the respective product. Garments are made only after you order.
(3) Orders with several items may be delivered in separate consignments. This does not result in additional shipping costs for you.
(4) If an ordered product cannot be delivered because our supplier fails to deliver to us through no fault of our own, although we ordered it from the supplier in good time, we may withdraw from the contract. In this case we will inform you without delay and refund any payments already made without delay. Your statutory rights remain unaffected.
§ 5 Payment
(1) The payment methods shown during the ordering process are available. Payment is processed via the payment service provider Stripe.
(2) The purchase price is due upon conclusion of the contract.
§ 6 Discount codes
Discount codes can only be redeemed before the ordering process is completed and apply subject to the conditions communicated in each case. Payment in cash or subsequent crediting is excluded.
§ 7 Retention of title
The goods remain our property until payment has been made in full.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal. The details are set out in our withdrawal information.
§ 9 Liability for defects
The statutory rights in respect of defects apply.
§ 10 Liability
(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.
(2) In the event of a slightly negligent breach of an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely (material contractual obligation), our liability is limited to the damage that was foreseeable when the contract was concluded and is typical for this type of contract.
(3) Otherwise our liability is excluded.
§ 11 Customer account
(1) Creating a customer account is optional. If you create one, you are obliged to provide accurate information and to keep your access data confidential.
(2) You can request the deletion of your customer account at any time by email to info@lescannasseurs.de. Contracts already concluded remain unaffected.
§ 12 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
(2) Should any provision of these general terms and conditions be invalid, the validity of the remaining provisions is not affected.
